Terms of Use for Polly

Welcome to Polly. By downloading or using the Polly Fitness app ("Polly"), you agree to these Terms of Use, the Apple End User License Agreement referenced below, and our Privacy Policy.

1. Apple Standard End User License Agreement

Use of Polly is governed by the Apple Standard End User License Agreement (the "Standard EULA"), which forms the core terms between you and Polly. The Standard EULA is published by Apple and is available at:

Please read the Standard EULA carefully. By installing or using Polly, you accept it.

2. The app and your account

Polly is a fitness coaching app for walking, running, and cycling. To use Polly, you sign in with Apple or Google. You're responsible for keeping your sign-in credentials secure.

You may use Polly only for personal, non-commercial purposes and in accordance with these terms and applicable law.

3. Elevation+ subscription

Polly offers an optional auto-renewing subscription called Elevation+, available as a monthly or annual plan. Elevation+ unlocks Elevations 2 and beyond across walking, running, and cycling, and any future Elevations we add over time.

• Free trial. New subscribers may be eligible for a 14-day free trial. If you do not cancel during the trial, your subscription begins at the displayed price at the end of the trial.
• Auto-renewal. Subscriptions automatically renew at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends.
• Pricing. Prices are shown in the app at the point of purchase and may vary by country.
• Managing your subscription. You can manage or cancel your subscription at any time in iOS Settings → Apple ID → Subscriptions.
• Refunds. Refunds are handled by Apple in accordance with the Standard EULA and Apple's policies. To request a refund, visit reportaproblem.apple.com.

4. Referral programme

From time to time, Polly may run a referral programme that rewards both you and a friend who subscribes through your share link. Participation is voluntary. Rewards are issued as Apple promotional offer codes. Polly may modify or end the programme at any time without notice.

5. Health and safety

Polly provides general fitness suggestions and is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before starting any new exercise programme, especially if you have a medical condition. You are responsible for moving safely and at a pace that's right for you.

6. Privacy

Our handling of your data is described in our Privacy Policy, which forms part of these terms.

7. Intellectual property

Polly, the Polly name, logo, and all related trademarks and content in the app are the property of Polly and its licensors. The Standard EULA describes the limited licence you receive to use the app.

8. Termination

You may stop using Polly at any time by deleting the app and, if you wish, by deleting your account from inside the app. We may suspend or terminate access to Polly if you breach these terms or the Standard EULA.

9. Changes to these terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and, where appropriate, notify you in the app. Continued use of Polly after a change means you accept the updated terms.

10. Governing law

These terms, together with the Standard EULA, form the agreement between you and Polly. Where the Standard EULA specifies governing law and jurisdiction, those provisions apply.
